Welcome to Presence ("the App"), operated by Xiuling Liu ("we," "us," or "our"). By using the App, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. Description of the Service

Presence provides personalized mindfulness guidance based on any input you choose to provide, such as text or an image. You are not required to provide any input to use the App. The App is designed to support present-moment awareness and reflection.

2. Services and Data Flow

The App uses third-party services to provide its functionality:

• An AI provider: receives and processes any input you choose to provide (such as text or an image), along with brief context about your current moment (approximate city, time of day, season, weather), to generate personalized mindfulness guidance
• Text-to-speech providers: receive generated text (not raw user input) to convert it into audio for playback
• A weather provider: receives your approximate coordinates to return weather information used by the home-screen widget and your guidance
• An authentication and cloud-storage provider: sign-in and limited data storage (account info, preferences, session metadata)
• A push-notification provider: registers push tokens and routes remote notifications to your device

These services are used solely to deliver the App's core experience.

3. User Input and Data Handling

To provide guidance:

• Any input you choose to provide (such as text or an image) is securely sent to our AI provider
• Generated text may be sent to a text-to-speech provider for audio playback
• You may choose to provide text, an image, both, or neither
• We do not store your input or the generated guidance after your session is complete

By using the App, you consent to this processing.

3a. Location and Notifications

With your permission, the App reads your approximate location to provide weather, time of day, season, and city context (used by the widget and your guidance), and may send you daily reminders that you schedule locally on your device, plus occasional remote notifications. You can revoke either permission in your device Settings at any time.

4. Use of the App

You agree to use the App only for lawful, personal, and non-commercial purposes. You must not misuse the App or interfere with its operation.

5. Generated Content Disclaimer

Content is generated automatically and may not always be accurate, complete, or appropriate. The App is not a substitute for professional medical, psychological, or therapeutic advice.

If you are experiencing distress or a mental health emergency, please seek help from a qualified professional.

6. Accounts

You may sign in using third-party authentication providers such as Apple or Google. You are responsible for maintaining the security of your account and for any activity under your account.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how your information is handled.

8. Intellectual Property

All rights, title, and interest in the App, including its design, branding, and functionality, are owned by or licensed to us.

You retain ownership of any input you provide, but grant us a limited right to process it solely to provide the App's functionality.

9. Disclaimer of Warranties

The App is provided "as is" and "as available." We do not guarantee that the App will be uninterrupted, error-free, or that generated content will meet your expectations.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages resulting from your use of the App.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.
